Employing EU/EEA and Swiss citizens in Slovakia

An employer who employs an EU/EEA or Swiss citizen in Slovakia has the following information obligation towards the Office of Labor, Social Affairs and Family:

  • An employer with a registered office in the Slovak Republic employing an EU citizen or an employer established in the territory of another Member State posting a worker to the territory of the Slovak Republic is, pursuant to Section 23b(6) of the Employment Services Act, obliged to inform the relevant Office of Labour, Social Affairs and Family of the commencement of employment or of the posting by submitting, in person or by post, two copies of the form (Information Card) containing the information about the commencement of employment or posting no later than 7 working days from the start of employment of such a worker.
  • The competent Office of Labour, Social Affairs and Family means the office in whose territorial district an EU citizen will be employed or will carry out work as a posted worker (i.e. the place of employment/work not the employer's registered office is decisive). The Information Card form will be submitted for each current vacancy to the competent office according to the place of work.
  • An employer with a registered office in the Slovak Republic terminating the employment of an EU citizen or an employer established in the territory of another Member State terminating the posting of a worker to the territory of the Slovak Republic is, pursuant to Section 23b(6) of the Employment Services Act, obliged to inform the Office of the termination of employment or posting by submitting in writing two copies of the form (Information Card) containing the information about the termination of employment or posting (as indicated on the front page) no later than 7 working days from the termination of employment or performance of work.
  • The employer shall keep a copy of the forms certified by the Office for the purpose of inspections carried out by the Office or the Labour Inspectorate. 
  • In the case of an EU citizen posted to work in the Slovak Republic, the relevant Information Cards indicating the posting or termination of posting shall be submitted to the Office at the place of work of the posted EU worker by domestic legal entity or domestic natural person (informing organisation) with whom the foreign employer concluded a contract regarding the posting of workers to carry out work in the Slovak Republic.
  • Failure of an employer or contractor to comply with the obligations to provide the Office with information on the employment/posting of an EU citizen and its termination on the Information Card is considered a violation of employment laws.
